DECREE OF THE MINISTER OF INDUSTRY AND TRADE

CONCERNING
THE APPOINTMENT OF SURVEYORS AS THE EXECUTORS OF VERIFICATION AND
TECHNICAL SURVEILLANCE OF IMPORT OF CITY AND RURAL BUSES IN NON-NEW CONDITION

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

that in the framework of implementing the provisions in Article 5 paragraph (1) and Article 7 paragraphs (1) and (2) of Decree of the Minister of Industry and Trade No.458/MPP/Kep/7/2003 dated July 8, 2003 on provisions and procedures for import of city and rural buses in non-new condition, it is deemed necessary to stipulate a decree of the Minister of Industry and Trade on the appointment of surveyors a the executors of verification and technical surveillance of import of city and rural buses in non-new condition;

In view of:

Decree of the Minister of Industry and Trade No.458/MPP/Kep/7/2003 dated July 8, 2003 on provisions and procedures for import of city and rural buses in non-new condition;

DECIDES:

To stipulate:

FIRST:

To appoint surveyors as the executors of verification and technical surveillance of city and rural buses in non-new condition which are imported in non-new condition, namely:

• 1. PT Surveyor Indonesia; and
• 2. PT Superintending Company of Indonesia (PT Persero SUCOFINDO)

SECOND:

The two surveyors as meant in FIRST Dictum are assigned to:

1. undertake verification and technical surveillance of city and rural buses in non-new condition, covering data or information on:

• a. the number of seats of 20 (twenty) passengers or more, including driver;
• b. axle configuration 1.2;
• c. chassis age of 5 (five) years at the minimum and 15 (fifteen) years at the maximum;
• d. right steering system;
• e. fulfilling road worthiness condition in accordance with the provisions in force;
• f. fulfilling gas emission standard Euro-1;
• g. the brands must have existed in Indonesia;
• h. marks, types and variants;
• i. countries of origin;
• j. frame no.;
• k. dimension;
• I. weight;
• m. propeller type/model;
• n. no. of engine;
• o. cylinder capacity;
• p. maximum power.

2. contain results of the verification and technical surveillance as meant in paragraph (1) into a certificate of inspection(COI) which is used as the basis for issuing type registration no (TPT);

3. convey written report on verification and technical surveillance of import of city and rural buses in non--new condition periodically, every 3 (three) months to the Director General of Foreign Trade in this case the Director of Import, Ministry of Industry and Trade.

THIRD:

In executing the verification and technical surveillance of import of city and rural buses in non-new condition, surveyors can collect compensation for the rendered services from importers of city and rural buses in non-new condition with the amount adjusted to the principle of benefit.

FOURTH:

All costs arising from the issuance of this decree are borne by surveyors.

FIFTH:

The appointment of the surveyors as meant in FIRST Dictum of this decree does not abolish the authority of the Minister of Industry and Trade to revoke, replace and supplement the appointment of surveyors as the ex-ecutors of verification and technical surveillance of import of city and rural buses in non-new condition.

SIXTH:

The Director General of Foreign Trade, Ministry of Industry and Trade stipulates technical matters related to the implementation of this decree.

SEVENTH:

This decree comes into force as from the date of stipulation.
